Terms & Conditions

Effective Date: October 1, 2026 • Commercial Advisory & Client Terms

01. Agreement & Acceptance

Acceptance of Terms

Welcome to the website of Crestpoint Risk Partners (“Crestpoint,” “the Firm,” “we,” “us,” or “our”). By accessing, viewing, or interacting with our digital domain (cpriskpartners.com), submitting an advisory inquiry, or requesting an underwriting review, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions.

If you represent an enterprise, corporation, partnership, or commercial entity, you represent and warrant that you possess full corporate authority to bind that entity to these Terms. If you do not agree to these Terms, you must discontinue use of this site immediately.

02. Advisory Scope

Nature of Advisory & Insurance Brokerage Services

Crestpoint Risk Partners operates as an independent commercial insurance brokerage and risk advisory consultancy licensed across all 50 U.S. states. It is critical to understand the distinction between our advisory role and that of an insurance carrier:

Intermediary & Brokerage Representation

Crestpoint acts as your representative and strategic intermediary. We examine your operational exposures, design tailored risk architecture, and submit risk dossiers to admitted commercial carriers and wholesale surplus lines markets. Crestpoint does not act as an insurance company and does not underwrite risk on its own balance sheet.

Carrier Policy Dominance

All coverages, insuring agreements, conditions, deductibles, retention thresholds, sub-limits, endorsements, and policy exclusions are governed solely by the actual insurance contract issued by the underwriting insurer. Summaries provided on this website, in proposals, or via email are illustrative and subordinate to the executed policy form.

03. Binding Notice

No Immediate Coverage Bound Online

Crucial Insurance Notice

Submitting an inquiry, contact form, preliminary risk audit request, or email through this website does NOT constitute a binder of insurance coverage, a policy amendment, or an assumption of liability by Crestpoint Risk Partners or any insurance carrier.

Coverage cannot and will not be bound, altered, or renewed until you have received formal, written confirmation (a signed binder or policy specification) explicitly stating the inception date and coverage terms from an authorized Crestpoint broker or underwriting partner.

04. Client Obligations

Duty of Utmost Good Faith & Accurate Disclosure

Commercial insurance underwriting is established upon the principle of utmost good faith (uberrimae fidei). When engaging Crestpoint to market risk or structure coverage, the client represents and warrants that:

  • All submitted operational figures, historical loss runs, payroll data, gross revenue, property values, and driver qualification logs are accurate, complete, and verifiable.
  • No material facts, prior cancellations, regulatory investigations, or known incidents likely to give rise to future claims have been concealed or misrepresented.
  • Any operational expansions, mergers, acquisitions, fleet changes, or significant operational pivots will be promptly reported to our advisory team.

Note: Inaccurate or incomplete disclosures can lead to carrier denial of claims, retroactive policy rescission, or cancellation under applicable state insurance laws.

05. Disclaimers & Advice

Professional Disclaimers

The editorial publications, articles, risk insights, and whitepapers published on this site are presented solely for educational and informational purposes. They do not constitute formal legal advice, certified tax counseling, architectural engineering assessments, or formal underwriting guarantees.

Enterprise risk management requires individualized assessment. Clients should consult with their corporate legal counsel and certified public accountants regarding statutory tax obligations and contractual indemnification covenants.

07. Liability & Remedies

Limitation of Liability

To the fullest extent permissible by applicable law, Crestpoint Risk Partners, its partners, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:

  • Technical interruptions, site unavailability, or transmission delays outside our direct control.
  • Carrier underwriting declination, rate revisions, insolvency, or coverage denials issued by an underlying insurer.
  • Failure of the client to notify Crestpoint of claims within statutory or policy-mandated reporting timeframes.
08. Jurisdiction & Governing Law
